Summary of Key Provisions in the New Travel Ban issued on June 4, 2025,  Affecting Nationals of Iran and Afghanistan

The new presidential proclamation restricts entry into the United States for most nationals of Iran and Afghanistan. However, several important exceptions apply. The following individuals are not subject to the ban:

  • U.S. Lawful Permanent Residents (green card holders)
  • Individuals who hold a passport from a country other than Iran or Afghanistan and travel with that passport
  • Individuals who already have a valid U.S. visa issued in their passport as of June 4, 2025
  • Applicants for Immigrant Visas based on being the spouse, child, or parent of a U.S. citizen, or an adopted childof a U.S. citizen
  • Afghan Special Immigrant Visa (SIV) holders
  • Immigrant visa applicants who are members of ethnic or religious minority groups in Iran
  • Individuals eligible for diplomatic visas or visas to attend major international sporting events

In addition, individuals who do not fall under these categories may still be allowed entry on a case-by-case basis if:

  1. Their travel would advance a critical U.S. national interest involving the Department of Justice, such as serving as a witness in a criminal proceeding
  2. Their travel is found to serve a broader U.S. national interest, at the discretion of the Secretary of State and the Secretary of Homeland Security

These two exceptions are broad, vague, and highly discretionary. We expect additional guidance in the coming days and will share more information as it becomes available.

خلاصه‌ای از مفاد کلیدی در دستور جدید ممنوعیت سفر صادر شده در تاریخ ۴ ژوئن ۲۰۲۵ که اتباع ایران و افغانستان را تحت تأثیر قرار می‌دهد

رئیس‌جمهور ایالات متحده فرمانی صادر کرده که ورود بیشتر اتباع ایران و افغانستان به آمریکا را محدود می‌کند. با این حال، چندین استثنای مهم وجود دارد. افراد زیر مشمول این ممنوعیت نمی‌شوند

  • دارندگان گرین کارت (اقامت دائم قانونی آمریکا)
  • افرادی که گذرنامه‌ی کشوری غیر از ایران یا افغانستان دارند و با آن سفر می‌کنند

  • افرادی که واجد شرایط دریافت ویزای دیپلماتیک یا ویزای شرکت در رویدادهای بزرگ ورزشی بین‌المللی هستند

علاوه بر این، افرادی که شامل دسته‌های بالا نمی‌شوند، ممکن است در موارد خاص و استثنایی اجازه ورود دریافت کنند، در صورتی که

  • سفر آن‌ها به نفع یک منافع حیاتی ملی آمریکا باشد که وزارت دادگستری در آن نقش دارد، مانند شرکت به عنوان شاهد در پرونده‌ی کیفری
  • سفر آن‌ها بر اساس صلاحدید وزیر امور خارجه و وزیر امنیت داخلی، در راستای منافع ملی گسترده‌تر آمریکا تشخیص داده شود

این دو استثناء بسیار کلی، مبهم و وابسته به تصمیم مقامات هستند. انتظار می‌رود در روزهای آینده دستورالعمل‌های بیشتری منتشر شود و ما اطلاعات تکمیلی را به‌محض در دسترس بودن، به اشتراک خواهیم گذاشت
